The case was filed in a Florida federal court, accusing the NFT project of using and attempting to register penguin-related trademarks without permission. PEI Licensing claims the branding could confuse consumers and violates trademark and fair competition laws. Pudgy Penguins launched in 2021 as an Ethereum NFT collection and later grew into a major crypto brand. The project has since expanded with retail toys and a Solana-based culture coin called $PENGU.
