Washington is sending mixed signals on the CLARITY Act just over a day before its make-or-break Senate vote, and the disagreement itself is becoming part of the story.
Two Conflicting Reports
| Claim | Source | Details |
| “Clarity is dead” | Renato Mariotti, former federal prosecutor | Says multiple members of Congress and staff told him this directly in DC |
| Bill is on track | Faryar Shirzad, Coinbase Chief Policy Officer | Feels “pretty good” about odds; cites bipartisan momentum |
| Still very much alive | Kristin Smith, Solana Policy Institute | Says push is on for a September vote; most police associations now neutral or supportive |
Why Some Say It’s Not Dead
The Vote Mechanics That Matter
| Scenario | What Happens Next |
| Bill clears 60 votes on Sept 15 procedural vote | Momentum expected to carry it to final passage |
| Bill fails to reach 60 votes | Murky outcome; possible emergency talks, or the bill could stall entirely |
Why Legislation Matters More Than Agency Rules
Congressman French Hill argues relying on SEC or CFTC rulemaking instead of a real law is risky:
What CLARITY Actually Changes for Each Asset
| Asset | Current Status | What CLARITY Would Do |
| Bitcoin | Generally treated as a commodity; CFTC oversight limited to fraud/manipulation | Gives CFTC direct regulatory power over Bitcoin trading platforms |
| Ethereum | Regulatory status has long been ambiguous | Creates a formal pathway: fundraising under SEC, later trading potentially under CFTC if sufficiently decentralized |
| XRP | Same ambiguity as Ethereum, further complicated by past SEC litigation | Same dual-track framework, offering a defined route out of securities classification over time |
What Happens If CLARITY Dies
The Global Stakes
One Bitcoin-holding executive called CLARITY “a blueprint more countries will soon follow,” pointing to how the EU’s MiCA framework previously pushed countries like Brazil to accelerate their own crypto legislation. A failed CLARITY Act would remove that benchmark for other nations currently modeling frameworks on the US approach.
| Vote date | September 15 |
| Votes needed | 60 to clear first procedural hurdle |
| Biggest remaining sticking point | Ethics provisions and a handful of holdout senators on both sides |
| What’s confirmed | Nothing yet — both “dead” and “on track” claims remain |
Crypto analyst Tony said the Senate’s cloture vote on the CLARITY Act on Tuesday, could send the market higher if it passes, potentially triggering a major rally on the Bitcoin chart that altcoins would likely follow.
He pointed to a bullish divergence already forming on Bitcoin’s chart, alongside a bearish divergence in stablecoin dominance, as signs the market has simply been consolidating after its last major move rather than turning bearish.
Tony pushed back on bearish predictions tied to the four-year cycle theory, which call for Bitcoin to drop toward $30,000-$40,000 in October. He said the current charts don’t support that outcome, calling it a low-probability scenario despite it being technically possible. The analyst also flagged a separate crypto tax hearing scheduled in the House for Wednesday, September 16, saying progress there would add to an already eventful week for the industry.
Until the actual vote happens, both the pessimistic and optimistic accounts remain speculation rather than fact, and Bitcoin, Ethereum and XRP’s regulatory clarity hinges entirely on whether Washington can convert months of negotiation into 60 votes on the day itself.
